Terms and conditions of use of the mycow.eu web site

The www.mycow.eu web site is published by MyCow SAS, a company governed by French law with an address at BP 33, 94431 Chennevières-sur-Marne Cedex, France, registered in the Créteil Trade and Companies Register under number B 492 056 510, represented by Mr Eric Brandt.

In order to use the www.mycow.eu web site, either free of charge or through a subscription offered by MyCow, users must read and accept these terms and conditions.

2. PRESENTATION OF THE WEB SITE

The MyCow web site comprises daily news articles in English and a selection of tools and services enabling users to practice their English (discussion forum, web space for Citizen Stories, contacts, shopping) and a selection of teaching materials.

A large portion of these services and tools will only be available to MyCow subscribers.

The web site may be used by anyone who wishes to practice their English and to communicate in English.

3. INTELLECTUAL PROPERTY

All of the services proposed by MyCow, including sounds, images and content, are protected by intellectual property law and belong exclusively to MyCow.

In this respect, the foregoing are intended for personal use only. The reproduction and display of the web site components, in whole or in part, is strictly prohibited without the prior, express permission of MyCow.

4. HYPERTEXT LINKS

4.1 With the exception of links to the www.mycow.eu web site home page authorised by MyCow under the terms and conditions set out below, any link to a page of the www.mycow.eu web site that is not directed through the home page is strictly prohibited.

In any event, MyCow prohibits all links to its www.mycow.eu web site that originate from a site that breaches public morality or public policy provisions, that is of a violent, pornographic, paedophilic, homophobic or racist nature or that constitutes an invasion of the privacy of others.

MyCow is not involved in the creation of links to the www.mycow.eu site that originate from another site and shall not be liable for the content of such sites.

4.2 Users agree to refrain from creating a hypertext link to a site that is illegal, contrary to public policy provisions or public morality, contrary to MyCow's general terms and conditions or contrary to these terms and conditions of use.

MyCow exercises no control over these sites; as a result, it assumes no responsibility for the availability or content of said sites or the products and services offered thereon. MyCow shall not incur any liability on account of direct or indirect damage sustained by a user who accesses such sites.

The user's attention is drawn to the fact that permission may be required in order to set up a hypertext link to another web site. Users must check the policy of the site involved with regard to hypertext links.

5. PERSONAL INFORMATION

MyCow may collect personal information from users of its web site when they:

  • register on MyCow,
  • subscribe to the MyCow newsletter,
  • post an article or brief or other text to MyCow's "citizen stories",
  • take part in forums, chat rooms or meetings proposed on the MyCow web site,
  • purchase products or services offered on the MyCow web site,
  • subscribe to services proposed by MyCow.

In accordance with the French Data Protection Act (Loi Informatique et Libertés) of 6 January 1978, our data processing policy has been registered with the French Data Protection Commission (Commission Nationale Informatique et Libertés or CNIL) under number 1202416.

Users have the right to access, amend, rectify and delete their personal details by writing to MyCow at BP 33, 94431 Chennevières-sur-Marne Cedex, France. Users may also change or consult their personal details by clicking on "Edit my profile" on their Dashboard.

Information provided by users shall be retained for the statutory period applicable to the provision of evidence. MyCow agrees not to disclose or sell your personal details, unless required to do so under a statutory or regulatory provision.

6. COOKIES

MyCow wishes to install cookies on your computer. These cookies do not allow MyCow to identify you; they will simply register information on how your browser is used to consult the MyCow web site (pages viewed, viewing dates and times, etc.). This information may be used during subsequent visits to the MyCow web site.

This information will be stored on your computer for a period of 12 months after expiry of your MyCow subscription or, in the absence of a subscription, from your last visit to the MyCow web site.

7. USER'S OBLIGATIONS

When using the mycow.eu web site, users agree to comply with the laws and regulations in force, including but not limited to those regarding intellectual property, rights of the press, criminal law and, generally, the rights of third parties, in particular, personal rights, intellectual property rights such as rights of copyright, patent rights, trade mark rights, as well as the provisions of the French Data Protection Act (Loi Informatique et Libertés).

In this respect, the user agrees to refrain from providing, transmitting or collecting any elements (including but not limited to sounds, images, texts, drawings, signs, personal data and software links) of a paedophilic, pornographic, homophobic, violent or racist nature, which violate the privacy of others or, more generally, which are illegal or which are liable to infringe on the rights of third parties.

The user also agrees to refrain from engaging in any illegal activity on or through the mycow.eu web site.

Users' attention is drawn to the fact that MyCow reserves the right to suspend or interrupt access to the mycow.eu web site at any time and without notice in case of a breach of the above provisions.

Users may contact us by clicking on the designated "Report" icon if they ascertain that any user of our services has violated the statutory or regulatory provisions in force or the terms and conditions of use of the mycow.eu web site.

Users are reminded of the fact that they may be subject to criminal sanctions should they interfere in or in any way impede the operation of MyCow's web site.

The user expressly authorises MyCow to amend the texts, sounds and images appearing on our web site to bring same into compliance with the editorial requirements of the MyCow web site, on condition that the meaning thereof is not altered.
